Deadline Date for Professional Investor System

GAR has set the following deadline date for the system for transition to Professional Investor under the Financial Instruments and Exchange Act:

Deadline date: October 31 each year

  1. The Financial Instruments and Exchange Act has introduced a "Professional Investor System" whereby customers are classified as "professional investors" or "customers other than professional investors" (hereinafter referred to as "general investors"). Under this system, application of some of the rules that GAR must follow as a Financial Instruments Business Operator when the customer is a general investor, such as the "obligation to deliver documents prior to the conclusion of a contract," is waived.
  2. A customer may, at their own request, be permitted to change their status from "professional investor" to "general investor" or vice versa by following the prescribed procedures.
  3. In the case of transition from "general investor" to "professional investor," the period of validity is normally one year, but as stated above, GAR has set as the "deadline date" the first October 31 after transition.
    • If the deadline date passes without you requesting renewal, you will revert to "general investor" status.
    • If you wish to continue to be treated as a "professional investor," the renewal procedures will need to be completed before the deadline date, so please inform us if you intend to renew.
    • Renewal requests can be made from October 1 of each year (or the next business day if this falls on a holiday).
    • A customer who has changed their status to "professional investor" may ask to revert to "general investor" status at any time.
  4. If you have changed your status from "professional investor" to "general investor," you will not revert to "professional investor" status unless you ask to do so.
    • If you have changed your status to "general investor" you may ask to revert to "professional investor" status at any time.
